Making something illegal doesn't make it criminal no matter how many people are in prison for it.

If then enforcing it doesn't reduce the act, a true error has been committed.

What are some examples of this?

Drug prohibition had a long history of failure and making the problem worse with many other negative side effects with a large body of academic work demonstrating this
