I've never seen this play out in litigation, I'd be interested to do some research. I suspect state Court judges won't give a fuck and good luck on your appeal.

I should mention, I'm not saying you're wrong, I'm just used to Judges ngaf about purelaw. This is why AI won't replace lawyers because sometimes the "perfect" motion isn't what the Court wants.
This is why we must reserve our natural common law rights by designating “Without Prejudice UCC 1-308” every time we sign ANYTHING. Then there can be no court jurisdiction, period.
