Yeah. I agree with this argument. This point seems the same as that used by the cyberpunks during the times of repression against cryptography in the USA. But I think that this interpretation of the First and Second Amendments will be changed in the future, because ultimately, this argument implies that a hacker attack or any digital crime is also just text. I think that with the evolution of society, the layers of sophistication that are created assume new definitions from one or more elements of the past that are no longer connected to their origins.
