Yeah. I agree with this argument. This point seems the same as that used by the cyberpunks during the times of repression against cryptography in the USA. But I think that this interpretation of the First and Second Amendments will be changed in the future, because ultimately, this argument implies that a hacker attack or any digital crime is also just text. I think that with the evolution of society, the layers of sophistication that are created assume new definitions from one or more elements of the past that are no longer connected to their origins.

Concordo com o argumento e ele é quase idêntico ao usado pelos cyberpunks durante a repressão do governo dos EUA contra a criptografia até os anos 90. Mas acredito que futuramente essa interpretação legal da Primeira Emenda da CF dos EUA não vai mais colar.

Isso pois, com a evolução da da sociedade, as novas camadas de sofisticação que criam elementos a partir de um ou mais elementos pré-existentes mais que não mais herdam os significados de seus elementos de origem.

Assim, mesmo que qualquer informação digital seja, em última instância, texto, se o uso do texto se distanciar muito de sua definição de origem a ponto de perder sua característica de "discurso" ou "expressão" e passa a ter significado próprio. Se não fizermos isso, temos que admitir que um ataque hacker ou qualquer outro crime digital é, em última instância, apenas texto também.
