Is there an argument to mandate code be open sourced?

It would probably be a fucking shit show for months, but I feel like long term it would be a huge benefit to society and for freedom

The government can keep military shit closed sourced obviously

Code has been ruled as free speech by the US Supreme Court. So the First Amendment already mandates open source by virtue of it being open speech

That’s not how it works

Free speech =/ private speech.

Unsure if you could argue “trade secret” with code, but I imagine companies keep code private for competitive edge. That’s understandable

Actually I don't think the military benefits from closed source, they already use hardware devices for key management to anything sensitive, and they really shouldn't be using anything that can be hacked without the keys anyways.

And remember, the government gets hacked all the time.

The military doesn’t need closed source, they need proper operational procedures and hardware security.
