What do you think of copyright, especially pre-publication? And trademarks? I think replicating someone else's mark is fraudulent (but I am not so sure that fraud should be considered a common law crime)

No. Ideas cannot be owned. Either you keep it to yourself or it’s everyone’s.

Fraud is a different story.

If you mislead someone into a purchasing contract that contract is void.
