Yeah you’re referring to common law courts which actually did incredibly well in establishing stability in the “wild” west, which was anything but. He has some really good writing on that. Also I agree with most of your points.

(Fun fact, the entire era referred to as “the Wild West” and the entire western part of the country saw fewer bank robberies than modern Chicago sees in a single year 😆)
