From a legal perspective, it's a violation of a contract. There should be penalties for violating a contract.
And said penalties should be determined by the contract (and thus, the contracting parties).
Marriage is more than contract, most religions would agree--but it is not less than a contract. The State is involved because property ownership is involved. In marriage, two become one "with all their worldly possessions." If there is a breach of that contract the property of the one must be divided into two again, and that means justice is called to mediate. If there are children, again, a division must be made fairly.
There are religious and moral ramifications to both marriage and divorce but those should be handled by church authorities. The civil aspects must be handled by some disinterestrd third party with enforcement power (whether that's a State or could be something else I'm not sure).
Go to saudi arabia then. You can legally kill over adultry there.

No lets keep it equal. Gov should leave us alone regarding tax but imprison aldulters. That should keep the balance the same. 😅

I dont think my relationship is their business but I know my marriage license is through them. I cant pretend my gov has nothing to do with it.
Let’s look at a theoretical example. Married couple with 2 young kids. Something happens and they both decide to cheat. Get caught by Trudeau’s goons and both go to jail. Is that what’s best for that family?
Or if only the husband cheats but he’s the only one who works. Does that seem right to you?
Look, you can say the same about all crime commited by a couple then. And yes, they will both go to jail. This is called consequence. I think adding adultery to that list of crimes is ok with me. If a couple robs a bank, yes they both go to jail and the child will be taken away. We cant not put someone in jail for crime just because of other reasons. There are consequences and we cant just give out "get out of jail free cards".
I totally understand if you dont think adultery should = prison though. Many states it is already illigal, just no prison. Its a charge. I think that is a start.
