Paul - have you spoken to a lawyer/solicitor (whatever you call them)? I don’t see legal issues for relays. I see legal issues for client apps and media servers. The relay is not the one presenting the image/video. In fact it’s hard to figure out which relay is the source since there can be many sources of the same note.

Client apps. User is liable for what they post.

Media Servers. Generally carry liability for what they know about, or SHOULD know about, i.e. you can't avoid liability by not having a reporting mechanism, and you can't ignore that which you are told about. BUT generally no liability where your own ENFORECED rules are broken.

Relays - pretty much like media servers. So, in UK escorting is legal, and that content is fine on my relay. Blood in porn is defined in law as Extreme Pornography and is illegal. I am required to ban it, have a clear reporting system commensurate with my size as an org, and to ACT when I become aware of it. Whether or not my relay is the source is immaterial, what matters is that it is on my relay.

In the USA the spectre of SESTA/FOSTA etc will result in many relays being advised by their lawyers that such content represents a legal risk TO THEM. Some may be comfortable with that risk, others, less so.
