I mean, it sounds like judges do whatever they want. one recent example is the Daniel penny case where they just dropped the charge the jury couldn't decide on so they could deliberate on the secondary charge. 🤷‍♂️ I won't pretend to be an expert but I also won't pretend we aren't seeing some pretty novel legal strategies recently.
