Nor that. Taking all the counts and adding up the total maximum sentence for each is not how federal sentencing works (and not just any kind of “in theory the judge could….” kinda way, they can’t do that).

I mean, it sounds like judges do whatever they want. one recent example is the Daniel penny case where they just dropped the charge the jury couldn't decide on so they could deliberate on the secondary charge. 🤷‍♂️ I won't pretend to be an expert but I also won't pretend we aren't seeing some pretty novel legal strategies recently.
