I think the point is that "criminal activity" in this context is whatever the state wants it to be. And since the comunication on telegram is not encrypted, it is him who put himself in a position of allowing or not allowing someones comunication. In case of public groups, he put himself in position of allowing/not allowing public speech. It's a situation you do not want to be in.
Go after the criminals, not the platform.

He is not accountable about what others do. Also, if he is, then google for example is for sure guilty too. How many criminals use google services for example?
