If they had to do such thing they wouldn't communicate about it as per law they currently can't do it in a legal way, or at least not without activating some institutional mechanisms ( emergency state )

Communicating about something they are not legally entitled to do would be the dumbest thing to do
I don’t know where you live, but this very thing happens in the US on a regular basis. Legions of government lawyers comb through reams of obscure legislation looking for loopholes until they find one.

Yes. However, I stand by initial statement, regardless. If they can a abuse it, they will.
Of course they will, but think about it 2 secs. If they don't have legal basis to do so, why would they communicate about it ?
Globally speaking, if you see this kind of "official notes" going around, look for the official institution accounts to check if they broadcasted the note. If not, then it's probably fake.
