Legally it seems like a very important distinction that goes way over the head of any court I have seen.
There are no coins

Bitcoin is more like modern poetry.
I use random words strung together to send friends private messages that only they can read with their private poems.
This is something I advocate/educate on in my professional work. Being able to explain to a judge the nature of private keys, cryptography, and irretrievability has literally kept clients out of prison. We don't have debtors' prisons in the US anymore, but if a bankruptcy judge, for example, does not believe you when you say you lost your private keys, you will be sent to prison for contempt until you produce the money--which of course you may not be able to do even if threatened with contempt prison.
