When the legal matter involves a crime that was committed some time ago the evidence trail is often quite weak. A civil case has a lower standard of proof to a criminal case (the balance of probabilities) and so it is easier for the case to succeed on this level.

Then if the matter is successful the victim could file a criminal lawsuit after the fact - and the successful civil matter can be referenced. This is not about money - it comes down to the nature of the case and the likelihood of conviction.”
