You can control a man with brute violence but you can never truly OWN a man until he's convinced that your word is law, and obedience is a virtue.

New Tornado Cash Indictments Run Counter to FinCEN Guidance - Coin Center
"The factual allegations of unlicensed money transmission are in conflict with FinCEN's longstanding guidance that an 'anonymizing software provider is not a money transmitter,'" Coin Center's Peter Van Valkenburgh said.
https://www.nobsbitcoin.com/new-tornado-cash-indictments-run-counter-to-fincen-guidance-coin-center/
"If a person, for example, had the ability to move any and all funds locked by that contract then it may be true that said person accepted those funds and was transmitting them on behalf of whoever put those funds into that contract, i.e. said person was a money transmitter. However, if a person merely had the ability to update certain logic relevant to the contract but insufficient to gain control over the funds and transmit the funds at their discretion then said person would not have what FinCEN in the guidance calls “independent control” over the funds being transmitted and would not therefore be a money transmitter. The indictment does not clearly state the manner of the defendant’s control and therefore does not sufficiently allege unlicensed money transmission."

"The headroom there isn't unlimited expect it to show up as fee pressure and backlogs and less ability to quickly resolve transaction storms. And that will in turn make it hard and expensive for people with small stacks to continue to do self-custody on the main chain. At that point, acquiring new high value users means pricing out existing low value users."'

While private cronyism is a risk without a state, empowering coercive monopolies like a king or patriarch is not the solution. Decentralized, voluntary exchange remains ideal. Smaller firms competing in free markets are less prone to cronyism than gigantic corporations. The key is separating economy from state, eliminating the power to tax and coerce. This properly aligns incentives with serving customers rather than bureaucracy. Though no system is perfect, maximizing voluntary exchange and local control provides the best safeguards against the perverse incentives and systemic harms that come from coercive state power.
The key distinction is that private firms rely on voluntary exchange while governments rely on coercion. Insurance companies must earn customer business through accountability and service. Government agencies face no such discipline and can persist through unjustified authority and taxation. Thus, the central problem is the illusion of justified state power. We must awaken citizens to the stark difference between voluntary and coercive institutions. The path forward is to restrain the state while empowering decentralized, voluntary solutions grounded in consumer choice and free competition. This is the antidote to unrestrained bureaucracy in all its forms.
"Without the erroneous public perception and judgment of the state as just and necessary and without the public’s voluntary cooperation, even the seemingly most powerful government would implode and its powers evaporate. Thus liberated, we would regain our right to self-defense and be able to turn to freed and unregulated insurance agencies for efficient professional assistance in all matters of protection and conflict resolution."
