The arg against (as it was in NY apparently) was that Trump wasn't acting in his official capacity. And even if removed, it looks to me like it would still be state law but in federal court (as in civil removal). Weird tho, and I dunno what happens w/r/t pardons if this happens.

* Yes, yes, I know! But regular lawyers can & do get in serious trouble & disbarred if we attempt even a fraction of the kind of shenanigans these MAGA clowns do. (Why there's so much of a difference in enforcement is left as an exercise for the reader.)
