Sounds like a really good way to centralize software more than it already is. Imagine having to compile something like an OS to avoid Microsoft, etc. Alas, this is what the EU does with this stuff. All they really do is screw consumers in the long term and strengthen the market shares of the companies they claim to be fighting. They are the only ones that can afford all the regulations.

On a philosophical side not, requiring that a party prove they didn't do something is a bastardization of the concept of justice. The person suing should be the one to prove that they were damaged.
