Isn't setting up bad incentives malice ?
Reminds me of the old Hanlon’s Razor adage. Yours fits very well, akin to Karl Munger’s “Show me the incentive and I will show you the outcome.”

malice-and-goodness layer is oblique to incentives; someone could demonstrate to himself to be really good if he act good when the incentives are all set to reward a malice act.
