That is a good question, but it doesn't matter in the way you think.
If they control the keys well, there are still legal claims over their coins, enforced by violence.
The problem is if they control them wrong and buyers lose their coins. That would be unfortunate.

The only reason I made that distinction is that it is important to not forget that when we see headlines saying "saylor/BR bought X amount of BTC".
That would be concerning if they actually were becoming whales. But they aren't whales, they are collections of shrimp.
