That sounds like a business. If the minters are printing tokens and you expect those tokens to increase in value, in order to exchange for bitcoin or anything else, then you are a security. They have laws on the books for securities.

It is hard to answer because energy output always requires an input. You would have to break some laws around energy production to get a zero cost energy source. Even when fusion becomes feasible it will cost something.

No, that isn't how it works. Miners can't flood blocks with ordinals without losing money in the long run. Imagine winning a 6 bitcoin block reward and spending 3 bitcoin to fill the block with garbage. The energy costs and miner costs would go into the red, unsustainable.
Writing ordinals has been possible for years, but with Twitter you get a lot of idiots that think it's cool, so you get a passing fad.
