I get what you are saying, but if that's the route the US wants to take they are going to do it regardless of what argument someone tries to bring up. Bringing up 2A doesn't open up any new attack vectors. They are either going to crackdown, or they aren't. When they attempt to crackdown which at this point may be inevitable, 2A is our strongest legal argument to try to use the legal system to stop them.
