I can't help but to see parallels between this "Money Service Business" applies to noncustodial services and The Pirate Bay's struggle against copyright trolls and, later, the Swedish State.

TPB also didn't host any illegal copyrighted content, they merely facilitated users sharing it beweem themselvs.

Samourai's Whirlpol, also didn't touch useers funds a merely passed message.

To me, we are fighting the same semantics

They will simply find the semantics that let them ban what they want to ban.

They profited off the facilitation tho

Yeah, I had a similar thought.

And the result will be exactly the same - jail time.

We learned nothing from TPB?

Decentralized or nothing. It's the only way.

So Samurai Whirlpool is like an ISP? ISPs make a profit connecting people to the Internet and people use that connection to purchase stuff with a credit card (ie Amazon) or to do fiat banking with their financial institutions. So, the ISP is a “Money Service Business”? 🤔 now what if that connection is at a coffee shop where there is no KYC of the coffee shop customers. Oh my! The whole Internet should be arrested!

I hope the judicial system sees the idiocies of the US government over these arrests and illegal enforcements…

The Pirate Bay was also only providing magnetic links which were just small pieces of non-copyrighted data.

That's my point: the State will twist semantics until it gets what it wants.

Sure, but Samourai didn't offer copyright content, NOR did it facilitate the transmission of money, according to most "US authorities" - Just that one whose entire case hinges on Bitcoin being money WHILE at the same time attempting to not contradict all "authorities" that say it isn't.

That's the gist, but I don't think Samourai actually facilitated anything other than matching peers to allow fields in a ledger to be updated with different private keys for access.

Yes, it's all semantics, but that's exactly why this entire case should force all those "authorities" to come out and state what they actually consider Bitcoin to be - It'll either not matter, or we'll just win quicker.
