They can know that and know what adress you made a transaction to.
And they can know how much you have in the adress that they get the kyc.

Embezzlement is a felony, it means to illegally take possession of. The opposite is to lose, it means to legally forgo the possession of.
No amount of chain analysis can prove the absolute ownership of bitcoin. If you've been charged you can simply move to another jurisdiction and spend it there without ever moving it. No judge in any court can ever legally prove that you had any bitcoin at the moment of the hearing.
