I know they can do this but fuck me the optics of it are juat awful. If he had any sense he'd at least be making offers and then require an NDA from the people who take it. That way he can say "We made an offer and they refused. Our ToS has always stated @handles are property of twitter"
It takes very little effort to write to the owner and simply say:
"We're going to take this handle regardless as our tos allows but we'd rather make a you a fair cash offer before doing so as a gesture of good faith. Sign the Nda to receive your money"
