"The kangaroo is a funny animal. When attacked, it defends itself." ~ Neville Cardus "This is what I observe or expect to happen" isn't the same as "This is what I want to happen." Not even remotely close. "Learn to shrink yourself to the size of the company you are in. Take their tone, whatever it may be, and excel in it if you can; but never pretend to give the tone. A free conversation will no more bear a dictator than a free government will" ~ Philip Dormer Stanhope, 4th Earl Chester

nostr:npub1tf489l2mm4jgjxs5s9anxfx40vt0ptt99ls8yfs00t3t8vjkjntq4cnzuj Madison warned us against Issue One: the GOP plan to replace a 50.1% majority with 60% to amend the Ohio constitution.

If approved, "it would be no longer the majority that would rule; the power would be transferred to the minority” when it comes to passing laws or other measures, he said in Federalist 58.

Worse, Issue One + GOP gerrymandering together will put bad legislators and bad policies out of reach of the voting majority.

Issue One is tyranny of the minority in action.

Did Madison heed his own warning when he agreed to the electoral college or denial of the franchise to women, the poor, and the 3/5ths people in Federalist ?

Our inequality is rooted in the Constitution whose authors we inexplicably revere unquestioningly for their wisdom. They did what was right for them. It helped replace a monarchy with a constitutional aristocracy.

The nation is running as designed.

Unfortunately.

Correct. But there is clarity on how you *get* on the SCOTUS. Which is what I emphasized.

Unless you have been nominated by the president for the SCOTUS and confirmed by the Senate.

Congress can definitely regulate the size, which is why I offer packing as the simplest solution. We have done it, and there is ample legal precedent.

There is no way to remove the doleful influence of Clarito, but you can dilute their influence.

What if the court was drawn from a random assortment of Circuit Court judges for each case. No way to curry favor ahead of time, no partisan shenanigans to kick the choice of judges over to the next president...

Sure. It'd take more wrangling over the terms, and very likely a constitutional amendment, because the inclusion on the court is governed by nomination by the president with confirmation by the Senate.

If he does it again, it’ll quickly go to a judge.

This is an explicit “you didn’t tell me not to” flex by Trump to see what he can get away with.

He will comply and his lawyers should be advising him that behavior can instantly put him behind bars.

There will be no trial or appeal.

Over the next month or so, you may see more posts like that from him, and predictably (and smartly) neither the judge nor the prosecutors will react to them.

They don’t want to make him the center of attention he desperately wants to be. Teri covers it well.
